Legal Question in Personal Injury in Florida

I was meeting a supplier at the Walgreens parking lot. I was receiving delivery from the supplier when the driver arrived, I motioned him to back up to the receiving (my) vehicle. He backed up a little too close and I motioned for him to pull up as I lowered his tailgate so that I could accept his load. As he started to pull forward, I turned around to lower my own tailgate so that we could transfer his load to my truck. As the delivery driver shifted to park, he accidentally hit reverse instead as he jumped out of the truck. The truck rolled back and contacted my legs, pinning them between the lowered tailgate and my own vehicle. At this time I yelled for him to pull the truck away from me as I was pinned and could not move to free myself. He jumped back into the truck and pulled forward relieving the pressure on my legs. After the accident I was not in much pain and told the person that hit me that I didn't need a doctor.

Since the accident, I have been experiencing back pain, leg pain and headaches which I've never experienced in my life.

I am wondering how I should address this situation and any advice would be appreciated.

Thank you.

You should certainly seek medical help for your injuries and pain. In the event you wish to attempt to recover monies for your injuries, you should contact a personal injury attorney to discuss your case with you.

Your own auto insurance will pay for some of your medical bills through the PIP coverage on the insurance policy. In addition, you may have a claim against the other driver's insurance to recover for your injuries.

These cases become complicated. You should really consult with an attorney in your area who is skilled in handling injury claims. In particular, you should look for an attorney who is board certified in civil trial law, as are the attorneys in our office. We offer a free initial consultation and would be happy to speak with you about the situation.

I agree with my colleagues. You do have a claim, your insurance will start coverage and you should seek medical attention. However, I am curious to know how long between the incident and when the pain started? Also, what was the date of the accident? I am guessing there was no police report filed and that you finished your day of work without significant incident. These are things that will need to be explained by an expert. Thus, the attorney you choose should have the ability to front the costs for these experts to testify. I hope you have sought medical attention and that your condition has improved. Best regards, Tami Diebel
