It depends. If the person that hit you is in another state, you can usually sue in that state. If the person that hit you was a Florida resident, you will need to sue in Florida where the defendant lives.

Generally, the answer is "no". Unless, of course, that the person who was negligent happened to be a Kentucky resident as well.

In the past, litigating a case from another state was a big hassle in terms of the distance. However, so much of the practice of law can be done electonically (email, video conferencing, etc.) that it matters much less anymore.

You can have a lawyer from another state if he is licensed to practice law in Florida. It is best to consult with a lawyer in the state in which the accident happened.
