Legal Question in Personal Injury in Florida
Am I overreacting?
Here is the situation: 1 year ago I broke my fibula stepping off a 13-inch high step at the local fair. I went to a PI attorney and he stated that it looked like we had a case since the step was so high. During the time my leg was broken, I sucked it up and continued with school and work. I spoke to my attorney's assistant months ago asking for the status of my case, and she stated that they were still gathering medical records. Another month followed, and I called again. Same old story and they had me sign a release I had signed at least twice before. At that time the assistant indicated that my case was going to be ''referred out'' because there were no damages. That upset me because, well, if you've ever had a broken leg you know how hard it is. Anyway, I sent a polite letter telling them that I was upset because it sounded like they were dismissing my case. The assistant called me and said ''You should know there are no damages'' because I work in a law firm. I work in an ELDER law firm and have absolutely no knowledge of PI stuff so I thought that was rude. She said they would respond in writing. That was in September and I have not received any letter or calls. I am really upset because I feel ignored and like I'm being led on.

You are not over reacting. Check with them to see if they are even proceeding with the case. You have only 4 years from the accident date to start a lawsuit.

You should proceed on this immediately.
