Legal Question in Personal Injury in Florida
Parental Rights
Our son was struck by a car in Florida and received a traumatic brain injury. He was 22 at the time of accident. Does Florida allow the parents of the accident victim to sue the driver for mental anguish, pain and suffering, etc? This seems to be a gray area for us.

I'm sorry to hear about your son's injury. There are many legal ramifications of this collision. You really need to consult directly with an attorney in Florida.
Re: Parental Rights
Depending on when the accident occurred, any filing of any claim may already be barred by the statute of limitations. The short answer to your question is "no". If you have not already retained a lawyer, feel free to call or write my office if you wish to discuss this matter.
Re: Parental Rights
If your son received "traumatic brain injury" it is necessary to know if he was rendered incompetent or comatose or ultimately died from the injury. Your question is confusing and any simple reply would be possibly misleading you. It is also critical to know the state you reside in as well as where the accident happened. The law is not simple and differs in each State. You do not mention if your son was married. That would change everything. You do need an experienced attorney's advice and investigation.
