Legal Question in Personal Injury in Florida

Parental Rights

Our son was struck by a car in Florida and received a traumatic brain injury. He was 22 at the time of accident. Does Florida allow the parents of the accident victim to sue the driver for mental anguish, pain and suffering, etc? This seems to be a gray area for us.

If your son received "traumatic brain injury" it is necessary to know if he was rendered incompetent or comatose or ultimately died from the injury. Your question is confusing and any simple reply would be possibly misleading you. It is also critical to know the state you reside in as well as where the accident happened. The law is not simple and differs in each State. You do not mention if your son was married. That would change everything. You do need an experienced attorney's advice and investigation.
