Legal Question in Personal Injury in Florida

I was a passenger in a car that was hit in rear at light. The man that hit the car was state limit and bodily is only 10,000.00 dollars. The driver of the car I was in has uninsured motorist 100/300 policy. Will that pick up the difference?

As a general matter, uninsured/underinsured motorist coverage will "pick up" the difference where there is inadequate or no bodily injury coverage. To know for certain in this case whether or not the driver's policy would cover you as a passenger, you would have to check the policy language. I would suggest you consult an attorney.

Yes. You would be covered under his policy.

Hello,

I'm sorry to hear about your accident and injuries. You are probably covered by the underinsured motorist coverage on the car in which you were a passenger, as well as the insurance coverage on any car that you own. However, insurance coverage issues are complicated, and I would strongly suggest that you contact an attorney who is experienced with these cases. For example, if you accept money from the negligent driver's insurance company without first getting permission from the other insurance companies, you may waive your right to collect any underinsured motorist coverage. We offer a free initial consultation, and would be happy to discuss the situation with you.
