Legal Question in Personal Injury in Florida
personal injury case
I was involved in a accident Jan 3,2009 will mark 1 year. I have been through h*ll. I know all things can be worse and consider myself to be very lucky. Since then my life has changed dramatically. I got a lawyer that I was looking out for my best interest. The lawyers ''claim'' I gave them the ''ok'' to settle my claim, which I did not!! I was VERY displeased with the so called settlement,so I said I wanted to go to court. They made it seem like they just wanted me to sign and go. Thank goodness I read EVERYTHING by signing the release that would release the at fault party for EVERYTHING! I will NEVER be the same again. I started to do some research on my own and found out the at fault party parents may own a business. This accident has left me 13% permantley impaired and I'm able to collect disability. I can't believe that the sttlement was not even a third of what a would've made. There's so much I cannot do prior to this accident! I am still suffering from pain and just trying to do daily things I took for granted. I feel my lawyers did not fight at all. Pain and suffering alone is worth more than what they offered. I REFUSED to sign ANYTHING!! I was wondering can I hire another lawyer and can I sue in civil court? Please help!

It is rare that anyone is "happy" with a settlement. You do need a second opinion from another lawyer to review the file and give you advice as to how to proceed. Read your "Statement of Client's Rights".

Did you accept a disbursement of the settlement? If not and you did not sign a release, you should contact your lawyers and tell them you would like to proceed to court. If they cannot help you, request a copy of your file and you can likely find another attorney who will review it for you and provide you legal advice as to how to proceed.

You are always free to obtain a second opinion.
