Personal Injury as a passagener

My 18 yr. old daughter was a passanger in her roomates car when they struck the back of a police car. Although she was not transfered to hospital, she later in the day went to the emergency room for xrays and complaining of pain. She was released with rx's for swelling, pain etc. Although I must go thru my auto ins. co. for coverage under my pip, the driver's auto ins. co. has agreeeded to pay any out of pocket expenses and has offered a settlement check of $250.

Although I feel the injuries are minor and being treated, should we accept their settlement or should we ask for more

Florida law requires a "serious injury" before you can be compensated for pain and suffering in auto accidents. Wait a while to see how her injury goes & then she can settle.
