Personal Injury Settlement

My husband was injured in a car accident. The at fault party was cited and 100% responsible. Since Jan 1,2008. He has been out work and will soon collect disability due to the accident. The settlement came back to be approx.$11,500. This is not even a faction what we would have made. Not to include pain and suffering, lost wages and future medical bills. What would my chances be going to court? Can I sue them in civil court? I did not sign a release form because anything in future would be my responsibility and that is not fair in my opinion due to the fact this happened because of the at fault party. I know each case is different, but how is one case worth 500k and mine only $11,500? I'm not happy with the outcome so if I seek another lawyer how do they calculate what I owe them for their servicrs.

You have not given enough info for me to answer the question about what your chances are. If you get another lawyer, how much you pay would be up to what you agreed on in the contract you signed. Your first attorney should have a lien for his fee based on the initial settlement he is recommending.
