Legal Question in Personal Injury in Florida

personal injury/work comp

Can a sheriff deputy sue me for a slip/fall down my steps after i called for help regarding a domestic incident? This is my home and would thus harm me - also I don't have insurance. Wouldn't this send a chilling effect to victims who need help? Also, she failed to use due care because 3 other cops failed to fall, i didn't fall, and a drunk chasing me down stairs never fell. Can I countersue for the duress this is causing me?

Yes, anyone can sue anyone in the State of Florida. It is up to the deputy to prove that there was a hazardous or negligent condition which caused the injury. Frankly, once the deputy finds out that you do not have insurance, the lawsuit may be dropped but that is not a "sure thing".

You should consult a local attorney to discuss your legal rights and obligations.
