Legal Question in Personal Injury in Florida
playground equipment accident at daycare
My daughter received a broken arm at her daycare. I was told that it was the cause of a merry go round going excessively too fast. What rights as a parent do I have to get compensated for the time and medical attention my daughter sought. Should I ask the daycare to pay for the doctors bill and time lossed from my job or should I seek legal action.

Ma'am:
Sorry to hear about your daughter's troubles. There may be a couple groups who are liable for your daughter's medical bills (the amusement company OR the daycare center). Most companies have an insurance policy to pay medical bills whether it's their fault or not.
Fee free to call me if you'd like to discuss this further. I am licensed in NJ and would be happy to discuss this potential case with you, if you like.

I am sorry to hear about your daughter's unfortunate accident. There is certainly the possibility that the daycare center may be liable (held responsible) for your daughter's accident and her resulting injuries. However, in order to determine whether they are responsible b/c they were negligent in their duties to you and your daughter a further investigation must be conducted to figure out exactly what happened.
I would be happy to speak to you further regarding this unfortunate situation. Feel free to contact me by private email or by telephone to set up a free consultation. My firm and I regularly handle cases like this and do so on a contingency basis, meaning that you do not pay me an attorney's fee unless I am successful in collecting damages on your behalf for you.

If a malfunction was the cause of the accident, your daughter would be entitled to compensation over and above medical reimbursement. Good luck.
