Rear end coll. w/injury to back and neck, not my fault-what are legal remidies?
About a month ago I was rear ended while stopped in traffic by a lady going approx. 45mph and was "sandwiched" between her van and a truck. My car sustained around $4000 in damage (her insurance is fixing). My neck and back were injured, and I am getting treatment. I have since sold my home, and am unable to pack and move my belongings. Is the insurance responsible to help pay someone (movers) to pack, which normally I would be able to do myself? Please answer as soon as possible, as I only have 30 days to move. Thank you.

At first blush,Pip carriers have covered such expenses.You may also recover such expenses against the at fault party's carrier. However I would need to review all insurance policies to give you a more certain determination.

WOW, $4000 in property damages. No wonder you're hurting! Please continue your rehabilitation and take your doctor's advice. Your own ins carrier is responsible to pay your health care ,lostwages and other specified expenses. Your general damages consist of loss of enjoyment of life,pain and future projected damages. Your current predicament is compensable as general damages. Unfortunately,you will not receive your money until your entire case is ripe for settlement.
