Was rearended and now am having problems

Several months ago I was involved in an accident. I was rearended by a man that was driving a big U-haul truck. Although I was hit hard there was no damage to my vehicle. I was feeling ok other than being very shook-up so the man just gave me his name and phone number in case I ran into any problems later on. That evening I was feeling pain in my neck and went to the emergency room and was given some muscle relaxers and some medication for pain. Ever since the accident I have been suffering from headaches and I was told by the dentist that I have TMJ. I also recently saw a chiropractor and he told me that I indeed have some damage. Is it too late to get the man to take care of my medical bills? What should I do in a case like this?

Assuming that you carried automobile insurance, then your personal injury protection insurance (P.I.P) should pay a significant portion of your medical bills. Did you also maintain med/pay coverage?

You may need to file a personal injury lawsuit against the driver. If he was not the renter of the vehicle, then you may also want to file suit against the renter. U-Haul may also have some liability.

The statute of limitations on this type of claim is 4 years. With no accident report, no property damage and, apparently, no witnesses other than you and the truck driver, you may have a serious problem proving your case.
