Legal Question in Personal Injury in Florida

Does a release of claims expire?

I was injured and the other party's insurance company gave me a release of claims. Thankfully I didn't sign it because I had addition injuries that were discovered much later. Does a release of claims expire? And what effect does an unsigned release have on the statute of limitations or filing a lawsuit? The insurance company won't agree to pay my additional costs. Did the agreement and offer stop the clock on statute of time? Thank you!

Re: Does a release of claims expire?

An unsigned release is just a piece of paper or trash. Florida has a four year statute of limitations on auto accidents. You need a lawyer to properly present your injury claim. I hope your time for suit has not already expired. There is some case law that may extend the statute based upon pending settlement negotiations but don't count on it. See a lawyer. You may also have an uninsured motorist claim with your own insurance company. Check your policy.

An unsigned release does not have any affect on your lawsuit or on the statute of limitations.
