Legal Question in Personal Injury in Florida
During a remodel at the grocery store where I work in FL, they left a 6" diameter drain cap sticking out of the floor 1.5". It was not covered with a cone. I tripped over it & felt a tearing in my knee. They told me they would check to see if they wanted to file a WC claim. 3 weeks later I insisted we open a WC case. X-rays revealed chips at the end of the kneecap. The Dr. said the medial collateral ligament was probably torn. I was put on restricted duty-which my employer didn't honor. After 2 weeks the Dr. said I had reached MMI but could reopen the case within 1 yr. Now, 4+ mos later I am in constant pain every day, walk with a limp & have taken so much Aleve I have probably ruined my liver. Do I have a negligence case? What should be my next step?
