Who is responsible for helping to pay my medical bills?

I was in an automobile accident on May 11 1997. I was Hospitalized for 1 week for a broken leg. I had to have surgery to repair the bone. While in the hospital my fiance reported the accident to his insurance because his car was involved inthe accident. We where told that even though I was named as a secondary driver on his policy they would not cover me because I lived in my mothers home. I was told that i need to make the claim through my mothers insurance co.. They say that their not going to pay any thing because I didn't make a claim within a 24 hours of the accident, and because I'm not listed as a licensed driver living in her home. The guy that hit us only had the minimum requirements for the state of florida ( PIP, & Liability). He also had the same insuranceco. as my fiance's. All I'm trying to find out is who is reponsible for helping to pay the $37,000 + in hospital and doctor bill's.

Who is reponsible for helping to pay the $37,000 + in hospital and doctor bill's?

Normally your own ins. co. if you own or live with someone who owns and insures a motor vehicle. A resident relative is generally covered whether listed by specific name or not.You are required to promptly report any claim and to cooperate in any investigation. It doesn't sound as tho there has been any prejudice to any company and you should document your claims by writing letters and filling out PIP claim forms with both cos.You may have to sue both carriers for a court decision as to who is responsible.You'll need an atty. to help you if one of the companies doesn't agree to pay. If you can't locate an atty. locally, contact me and I'll try to help you.
