Legal Question in Personal Injury in Florida
Was sitting at a traffic light 3 weeks ago when my auto was rear ended by a lady in a SUV at 45 mph. Light was red and she stated she forgot to stop. She never even applied her brakes.
She was driving a vehicle insured by FCCI Insurance (Commercial).
FCCI totaled my 2007 Ford Taurus after inspecting and adjusting..Bent rear left frame and a broken Drivers seat. Over $7000 worth of damage.
They made a settlement offer of 9300.00. Cannot replace the vehicle for this amount..Countered with $11,300 and total loss adjuster stated that she was reviewing request. This was over 7 days ago. Has not returned emails nor phone calls since. I get her voicemail with every call I make.
Have been very amiable concerning this up to now. Did not pursue criminal charges, medical assistance, Loss of work due to 2 days without rental, ect (perhaps being too nice).
Note: I am still in the rental car they provided 2 days after accident.
Do I need an attorney to protect my interests in this?

Yes, you need an attorney to protect your interests. Hopefully you have found one already that you trust. You should be pursuing medical assistance and lost wages. Insurance companies will give a very low estimate, especially if you do not have an attorney. I would be happy to discuss your case with you.
No. They usually only pay blue book value, not replacement cost. Good luck.
