can i sue if my daughter fell on a cactus in the yard and was in the hospital 4 days causing me to lose work and fall behind in rent and now they are trying to evict me

Interesting question. If this cactus was a yucca also known as a Spanish Bayonet I had a similar case for a client some years ago. I also had the dangerous spiked plant in the yard of my newly purchased home. After cutting the stiff spikes, I realized it was hopeess and pulled up all the plants. I have found the plants have been replaced by a similar looking cactus with soft non dangerous spikes.
