how do i sue someone in small claims court if the person hit my car and signed a written aggreement stating they would pay for all the damages within a 30day period the person has not paid me and is screening my calls however i do have a copy of his lisence number, car regestration and car insurance also the promisary note signed and dated by him and his witness(his girlfriend) saying he would pay within 30days for all damages.

You should go to the closest courthouse in your county and get some forms from the clerk's office to file a small claims case. They will have instructions on how you deliver the small claims complaint to the person who hit your car.
You said the magic words -insurance co-call them immediately and demand to be paid-even if he has minimal ins. it should cover your damage if it was in force at the time of the accident.
