Legal Question in Personal Injury in Florida

Traffic Safety for HOA Private Roads

Is a Florida HOA obligated by law to ensure traffic safety for their privately maintained roads? My HOA has inadequate speed bumps and drivers recklessly speed down the road. Can the HOA directors be held responsible for gross neglegence if a child gets injured or killed because of a speeding vehicle?

Re: Traffic Safety for HOA Private Roads

Yes. But I would put the HOA on notice that the speed bumps are inadequate so it does not use lack of notice as a defense.
