I was wondering if it is legal for a lawyer to solicate by phone reguarding a car accident??

The Florida Bar permits attorneys to send letters to people who have been in auto accidents. However, the letter that the attorneys send must be approved in advance (by The Florida Bar), and the attorneys cannot send a letter within the first 30 days after an accident occurs. I am not sure of the limitations on telephone solicitations. You should definitely contact The Florida Bar. Its nearest office is in Ft. Lauderdale. They will be very interested to hear about the phone call that you received.

I must disagree with my colleague, Florida law prohibits the use of police accident reports for any commercial purpose. The letter that Mr. Meyer refers to is an advertisement in general. The 30 days is in regard to the fact that an auto accident report cannot be obtained within the first 30 days.

I disagree with my colleague as well. Florida law does not prohibit the use of police accident reports for commerical purposes if it is beyond 60 days if the accident report is not prepared by a 'person' as opposed to a police officer.
