oral contract for payment of salary
My brother asked if my husband and I would we consider moving to Florida to help care for his two young children, after his wife died. We agreed to resign from our current positions (annual salary of approx. $120,000) In return, we asked for three things: A home in our name, health benefits and that he pay me a salary until I decided to retire.
We also considered the fact that he may remarry He said that it didn't matter, he would continue to pay me a salary.
Bottom line is that he bought a home but never put it in our name. no dental. Now, he wants to stop paying my salary. My brother remarried in March, 2002. He now says his business is not doing so well but in the last year he has purchased a new boat (200,000 - 300,000), a new cadillac SUV, a new mercedes for his wife, remodeled every room in his house and bought a RV He had a meeting with my husband and informed him that he is no longer going to pay me and wrote a check for 10,000.00. My husband has been working at a commission job for the last 6 months and has not earned any income. He is now in the process of looking for a position which will pay him a salary.

I don't see how you can enforce this oral agreement It violates the Statute of Frauds which requires certain contracts to be in writing to be enforced.
