Legal Question in Product Liability in Florida

I purchaed some stick deodorant and when I used it I broke out so bad that I had to see a doctor. I took pictures of my under arms and saved the deodorant. This appears to be a product liability case. I'd like to speak with an attorney who will accept this case on a contingency fee basis. I understand I would have to pay the filing fee to start the case. Is there anyone out there in Dade County, Miami, Florida, who will assist me? I await your respones. I am a security officer and I missed work because of the product used.

It would be very difficult to find a seasoned lawyer to handle your case. Products liability cases are very costly to pursue and therefore the damages have to be extremely large. Just think for a minte: You would have to find an expert to examine the product to see if it in fact caused the problem and is a danger to the public. That alone would cost many thousands of dollars. You would need a doctor to say the outbreak you had was a direct result of the product vs other causes, such as an allegic reaction to food or something else. Again, a few thousand dollars. The company would deny the claim and have its own experts. The cost to find out their opinions would cost thousands of dollars.

Genrally speaking, such cases cost out of pocket around $35,000 on up to pursue. Unless you are going to pay for the costs up front, a lawyer has to consider his chances of success vs failure and what he or she would earn in the end. Such a case would have to have a minimum value to the lawyer of $200,000 to even consider, and most would not take the chance on such a low value case. Your case does not seem to fit into this catagory based on what you have stated.

Sorry to tell you this, but it is important for consumers to know how lawyers evaluate cases and the difficulty of success. Your case is what the insurance industry would call a frivolous lawsuit, not because there is no truth to it, but because of its value.
