Legal Question in Product Liability in Florida
My stepmother traded her 2008 Toyota Corrolla in for a 2010 Corrolla on Jan 2, 2010.
The dealer changed the date to dec 31, 2009 on the paperwok. Ten days after getting the car (35 total miles driven to date) Toyota annonced the gas pedal problem. She is afraid to ever drive the car. The dealer sent a man to fix it at her home. It took 5 minutes to fix, but toyota and 2 dealers we spoke with said it takes 30 minutes of work to replace the part and fix it (assuming Toyota is correct about this fix). The dealer will not take it back even though they sold her a car with gas pedal, brake, and steering problems. We beleive this is a fraud since they sold the car knowing about the problem, and at the time there was no fix. The car did not come with a floor mat, when asked why they said they will get you a better one soon. This makes me beleive they definetly knew because at the time Toyota beleived the problem was the floor mat. My stepmother is 82, and never will drive this car or any toyota again. She is so scared, and stressed out about all of this she was taken to a hospital with chest pains, the doctors say it's stress. How can we force them to void the sale and take back the car, remember she only has 35 total miles driven in 4 months. We spoke to the dealer who has lied, and changed his story. Also sent many letters to Toyota, and other government agencies, but it has been a waste of time so far.
Please advise what we can do.
