Legal Question in Real Estate Law in Florida
In 2009, my goddaughter (14yo at the time) was sent by her mother, to live with her biological father whom she had not seen since she was 2 years old. She was sent, pretty much, with just the clothes on her back. Over the course of a year, she worked on building a relationship with her father, stepmother,and 2 sisters. During the course of that time, I have sent her clothes, photos,and books as gifts for Christmas, birthday,and throughout the year. I also packed up and mailed all of the clothes that she had at my house so that she would have clothes to wear. Over the summer of 2010, my goddaughter went to visit her mom and 5 siblings with the intent of returning to live with her father once school started; however, she decided that she wanted to remain in her mother's care. The biological father was and is upset with her decision and now refuses to send her any of the items that she has left. They gave excuses that they didn't have the money to send the items. I offered to send the money. The parents do not have a good relationship and long story short...the father is taking is feelings out on his daughter. I have asked several times for the items to be sent because my goddaughter needs clothes. They continue to refuse. Is there anything that I can do legally to obtain all of her possessions?

The question is who owns the personal belongings. If its the daughter, she can go with her mother and pick up her clothes. If the father refuses, they can call the local sheriff and request their assistance in obtaining the clothing.
