Legal Question in Real Estate Law in Florida
Hello,
I have an adult roommate with a 7 year old child, she is a single mother. We do not have a written lease as she had lived with me before without incident. She also has a 17 year old son that lives with his father. Last week she told me the 17 year old son would be babysitting her 7 year old son while her typical babysitter was on vacation.
She is now telling me the 17 year old will be living in our household. It was not an amicable discussion, and I was warned that it would take over 2 months to conduct an eviction. She stated she would do "the best that she can" to move out, but didn't want to commit to a date.
We finally agreed that she would move out on or before April 15th, 2010. That gives her roughly 8 weeks to save for the move. My question is what paperwork should I have in line that she is agreeing to move out. The research I've done on eviction covers non-payment or moving in people that are not your children. I don't want April to roll around and find that she wants to stay longer.

The only way to ensure that she will be out in April is to initiate eviction proceedings now.
