Legal Question in Real Estate Law in Florida

Allowing dogs in condo

My fiance and I have resently bought a condo. We really would like to have a dog, but the rules that were made just prior to us purchasing do not allow any dogs in the condos.

We do know for a fact that the board members relatives moved in after this rule was made and were able to keep their dog. All members have signed a petition to allow up to a 20 pound dog to live in an owners condo. This petition was rejected. What can my fiance and I do to allow a dog in our condo. Thak you

Re: Allowing dogs in condo

If another unit owner has a dog, you should also be able to have a dog. Restrictions as to the number, size or weight of allowable dogs are normal and reasonable. However, such restrictions must be applied uniformly to all unit owners. Therefore, if one unit owner is allowed to have a 20 pound dog, the Board cannot arbitrarily object to you having a 20 pound dog. Rules and regulations cannot be enforced in a discriminating manner. If you think it's worth the dog fight, seek the advice of counsel experienced in condo law. Good luck.
