Legal Question in Real Estate Law in Florida
Apartment complex refusing to repair
I have been living in this apt for the past 2 years. I recently advised them that I was moving at the end of the month. Yesterday, Saturday, the fuse box in the kitchen literally blew up..sparks flew out and lost power. After waiting nearly 4 hours for maintenance to show up w/an asthmatic child in the house, they chalked it up to the wiring from the compressor to the fuse box. All they did was tape the fuse leading to the compressor and left. Said they would be back today. It is extremely hot in here and w/my child having asthma its hard for him to breathe. I called them at least 8 times today and on the final call they told me it would be tomorrow. 2 days of no a/c in Florida is too much! I don't believe they are really coming. I had said to the girl that I think they are doing this because I am leaving and they need to put us up in a hotel until it's fixed. She said there are no managers on duty and I have to wait. Can they do this?

Re: Apartment complex refusing to repair
There is no requirement under Florida law that the air conditioning be repaired, especially not on a weekend. As I write this, it's only Monday morning, and the temperature in your zip code is 76, per weather.com. That's not bad for south Florida.
I'm not taking their side, but you have to give them a chance. You can't get an air conditioner repair man out the same day you call, and today was probably the first day they could call. The answer to your question is yes, they can do this. Calling eight times isn't going to help when they probably just opened less than an hour ago.
