Assessments in deed restricted community
Our deed restricted community documents have a provision that any special assessments fall evenly on each lot in the development. There is also a section that says the association has maintenance responsibility over all driveways in the development. Another section says that if a person choses to alter their driveway (such as seal it with a colored sealer) the association will no longer do anything to maintain that driveway - it reverts to the owner to maintain.
If the association were to decide to fix all the (other) driveways and pay for it with a special assessment, would the people who had to maintain their own driveways be ''exempt'' from such an assessment?

Without reading your specific documents I think your interpretation is reasonable.
