What is my legal recourse against a condo association attempting to foreclose due to special assessments not being paid?
Mortgage is not an issue

Pay the assessments. Florida Statutes Chapter 718 specifically provides that associations may foreclose on a unit for unpaid assessments.
I would strongly suggest you meet with a qualified real estate attorney who can review your situation and work with you to resolve this matter. This is extremely serious as you CAN lose your condominium for failure to pay.
