Legal Question in Real Estate Law in Florida
Currently association is being sued for not having issued special assessment for roof repair resulting in mold damage in two units owned by the owner who used to be president of the association at the time of first special assessment for roof repair. Moneys were miss managed and fund are missing from this first assessment. So now we are hit with another special assessment to redo same initial repairs on top of law suit settlement that owner is asking. Can we petition the court to order an audit by outside firm. I am certain that this audit will offer answers as to what happened to the moneys misappropriated in the first assessment resulting in ending the lawsuit because of the implication of the owner with regard to misappropriation of funds.
