Legal Question in Real Estate Law in Florida
Attn: Jill Beth Newman
I am considering purchasing a plot of land that is owned by 3 siblings.
The plot is in Florida. Do I need to have all 3 siblings sign over the deed for the purchase or can one of the siblings sign for all of the other siblings?
Can you handle this land purchase and how much do you charge?
Can I get your office contact info so that I may call and arrange an in person meeting with you?
Thank you very much for your help and information.
Agatha
1 Answer from Attorneys
Agatha, in most cases all three siblings would need to sign the deed. However, one person can act on the behalf of all three provided they have been properly appointed as "attorney in fact" through a Power of Attorney. The closing agent should ensure that the person(s) signing the deed have the authority to do so.
You may also want to contact a licensed attorney to review the sales agreement, and you should insist on a title examination. If you need any assistance my office can help.
