Legal Question in Real Estate Law in Florida

Awarded Florida property in Indiana Divorce-Ex has dissappeared without relinqui

''Wife shall receive as hers:'' then the legal description of Florida property is shown in my Indiana Divorce Decree. My ex has dissappeared, how do I get a ''quit-claim'' deed done to take his name off the warranty deed? My attorney says I have to have a Florida attorney do this., the judge says ask my attorney...it keeps going around with no answers to be found. Please help. I need to know what must be done to get my ex's name & claim off this property so I can sell it if I wish to. Please be specific on what an Illinois resident can do to have this done without knowing her ex's whereabouts. PLEASE HELP!!!!

All is not as easy as we would hope. Your Final Ind. judgment need to be domesticated in Florida, and thereafter enforced in Fl. Enforcement will have to be 'in rem', because the whereabout of your x-spouse is unknown.

I suggest you discuss this with your Ind. atty.Thereafter either you or he may call me ay 305-940-8080
