Background: My husband has homestead for his house which he had before we married and who's ex-wife name is still on the deed. I just purchased a home in my name only where my elderly mother will live along with me living there part time to care for her. Can I claim homestead for the new house?

There are three homestead protections. They are all different. If you are talking property tax reduction for homestead, you can only claim it once. The ex wife's name on the deed is not dispositive of ownership. Was there a judgment transferring her ownership to your husband? You have a homestead right to the home as his spouse, protected by the constitution, but that is different them the property tax reduction. To determine whether your new home qualifies for property tax reduction, seek some legal counsel.
