Bad Business
We had a realtor put in a contract to purchase our home under his fiances name only. The buyers had a 2 month pre-occupancy before closing. After the 2 months expired the buyers started to re-negotiate the price and closing cost issues with many delays on the closing date. The realtor and his Fiance who were occupying our property would change their minds continously whether or not they were going to close. Also, at time of contract they negotiated with us to pay only $750 per month for rent for the said 2 months occupying. We agreed on those terms because our house was on the market for 6 months with no contracts. Now, the buyers say they are not purchasing our home and they never paid the rent for this month and we never closed. I asked them to please vacate and on contract they are suppose to vacate within 10 days. We may need to evict, we will see in 10 days. We are now paying our mortgage in the house we reside in and continue to pay mortgage in this home with an equity loan because we can't afford paying 3 mortgages. Financially, we are in so much trouble because of these people. Could I file a lawsuit against this realtor and the company he works for? Did this realtor do anything illegal? Please help....

A review of the contract is necessary to see if you have any grounds for any action. Since the realtor was not a part of the contract,but took advantage of it, you may complain to his broker and/or file a complaint with the Fl Real Estate Commission in Orlando. Until your contracts are reviewed no determination can be made on whether you have a basis for a lawsuit.
