Legal Question in Real Estate Law in Florida
broken lease due to employment transfer
My husband was promtoed and transferred from Ft. Laudrdale to St. Petersburg , Fl. We were renting an apartment and had to break the lease. We gave a 3 month notice, cleaned the apartment turned in our keys and gate keys. now they are trying to collect $1500.00. We even had the facility that he was transferred to for the Federal aviation Administration send them a letter confirming our transfer on federal Aviation Administration letterhead. We were told the only way to be let out of the lease was to be in the military. is there any help for us?

Re: broken lease due to employment transfer
An employment transfer is not a basis for
breaking a lease. Since you gave so much notice,
the landowner should have had plenty of time
to find another tenant. If they did not
do so, you could raise as a defense the
doctrine of mitigation of damages. However,
by contesting the case, you would be subjecting
yourself to paying the other side's additiohnal
attorney's fees. I strongly suggest you try to
work out a settlement and get the advice of
an attorney.
