Can a builder lawfully mandate how long a residential house must be the buyer's
Can a builder lawfully include in the contract for the sale of a single family home, the requirement of a minimum of 1 year primary residence by the buyer before it is resold? The contract addendum states that the buyer will pay to the builder a fee of $10,000 in the event that the home is resold sooner than one year from it being lived in by the buyer. The buyer may not rent or lease the house either within this one year period. The house must remain the buyer's primary residence. Is this contract lawful?
