Legal Question in Real Estate Law in Florida

Builder has skipped town and my home is not complete

I believe my builder has skipped town and my home has just the dry wall up. This February will be two year aniversary of this project. I do not know what to do first. I have been paying interest payments and now I have depleted my savings and no home. The only thing I have is my credit and I want to do everything to protect it. What should I do first?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Your first thing to do is to meet with an attorney to discuss your options. Frankly, your situation is far too complex to answer in a paragraph or two. If the builder has filed for bankruptcy, you may have to file a claim there. If not, you may have to see if the property has been turned over to the lenders for the project (if it was part of one). The list of maybes goes on and on. Good luck.
