Legal Question in Real Estate Law in Florida
Buyers want me to pay for pool resurface after closing
I sold my house June 28, 2007. It was built in 1984 and I had only renovated the bathrooms and kitchen. An inspection was performed by the buyers and now they are saying the pool needs to be re-surfaced and they want us to pay for it to the tune of $5,000. They feel we knew it needed this work done and we should have disclosed that it was needed. We swam in the pool until the night before we moved out and were never told by our realtor that we needed to disclose the pool has a fiberglass finish vs. a cement finish. It is the first pool home we ever had and assumed all pools are made of the same finish. On the disclosure sheet their were no such questions asked about the pool nor did our realtor bring it up. I feel the pool was in perfect working order, it does not leak and I never said it was a brand new pool nor made of cement. They are threatening to sue us. What should I do?

If there is any issue with the pool , as you describe, it certainly is not latent. Do nothing. If sued, retain counsel and defend.
