buying a home from a friend they are getting divorced she gets the remaining balance of 27000 but with the home going into her name only she wants 40000

Sorry but this question does not make much sense. You are buying the home from someone who will get a house in a divorce? I have no idea what the 27k v. 40k means. you need an attorney to assist you
