If a resident of a homeowner's association requests information from the homeowner's association President, and he fails to turn over the information to them under Chapter 617, what is the remedy of the resident after waiting ten (10) business days for the homeowner's association to comply with the request?

Q. If a resident of a homeowner's association

requests information from the homeowner's association

President, and he fails to turn over the information

under Chapter 617, what is the remedy of the resident

after waiting ten (10) business days for the

homeowner's association to comply with the request?

A. Contact other board members with your request,

especially the secretary. Consult with an attorney

to contact the board or to file suit to compel

production. The statute,617.303, provides for

actual damages or $50.00 per day up to a max. of

10 days. F.S. 617.305 provides for attys. fees to

the winner.
