Legal Question in Real Estate Law in Florida
Civil Mediation Agreemenet Miami Fl
My husband and I were using this broker to purchase our home. Well, she turned out to be no good. There are a lot of details I am omitting, but we wound up scheduling two unsucessful closings with her. With the fault being hers for us not closing. Since we had never signed a contract with her, had deposited money on our home, and were facing fees for every day we did not close from our contracted date, we went with another lender. Our new lender closed us in 1 week with an excellent loan, whereby she had all of our same information for over 3 months. A year later, after she never even sent us a bill, she sued us for bogus fees. We had told her that we would pay somethings because she did help us find the property. That was not enough for her. We went to court. We entered into an agreement with her through court mediation. There was a stipulation that we paid her a certain amount as settlement over the dispute and it was also stipulated that she had to provide us a letter of satisfaction within 7 days from receipt of the payment. She sent us a letter of satisfaction 18 days later. We held our end of the agreement and she did not. Is that enough to void the agrmt? She is now legally harrassing us with ''friendly'' mailings

It does not sound like a material breach and the purpose of the agreement was fulfilled. Block her e-mail address and if she continues to contact you notify her in writing not to contact you again.
