Legal Question in Real Estate Law in Florida

Could not close on a home because we lender's could not give us a commitment letter, in the end the loan was denied. After almost 3 months of doing everything that was asked of us and spending money and the lender telling us that approving would be no issue. We have now cancelled the contract and given the lender's letter of denial with it. We had put money down and now the seller only wants to give back half of it, how's this legal?
