If someone is collecting rent for me on a house I rent out and they recieve the funds but do not pay it to me would that be considered theft. If not what recourse do I have to get my money?

You need to notify the tenant to cease sending payments to this person pursuant to the terms of the lease (you should review to see what other requirements you have to follow). You should also file suit against this person under a number of theories.
You need to make sure that the tenant knows where to send the funds and that it's written in your lease agreement. So, the first step would be to contact the tenant. You can file a suit to recover the funds against the other person. You may want to send a demand letter from an attorney before filing suit.
