Legal Question in Real Estate Law in Florida

Condo law/tile cracks ceilings

Upstairs condo owner installs 16X16 tile on top of existing tile. I, downstairs condo owner object and require her to get permission of condo assoc. as per condo rules. The association gives permission saying we have steel reinforcing beams in ceilings. My ceilings have 2 hairline cracks running the length of my condo ceiling after only two weeks. What should my course of action be? Thank you.--

Re: Condo law/tile cracks ceilings

Obtain a written opinion from expert that cause of cracks is tile placement. Then contact Condo Board to have ceiling repaired at their expense. Good luck.

Re: Condo law/tile cracks ceilings

Hire a Contractor to give you an opinion that the installation caused the damage and the estimated cost of repair. Check your Declaration of Condomnium; there is usually a provision that states that an owner is responsible for any damage caused by his unit or him to another unit (this comes up alot in plumbing situations, etc.)Write a letter certified mail to the Board and the upstatirs unit owner explaining the situation and asking for the names, addresses, policy #'s both of their insurers; also say that they need to check the installation so additional damage is not caused. Get the owner's insurance and submit your claim to that insurer. (that is who probably is responsible based on your facts; the Board's insurer is probably not). Submit your cost estimate to the other owner's insurer. Keep calling the agent until they pay you; be a pest.
