Condo purchase getting out of contract

Contract signed to purchase condo. Real Estate agent didn't disclose that condo assoc. forbids roommates.She lives in development and knows the rules and regs. I need roommate to help pay mortgage.Bank has 10% down. R/E agent knows I need roommate and met her; seller met my roommate on several occasions. Condo has my applic.and reviews app. for approval of purchase. How can I get downpayment back?

Your contract will indicate the terms on which you can get your downpayment back.

Unfortunately, if you back out of the sale, the seller will usually get to keep the downpayment.

I would think about suing the real estate agent. He/she did not disclose a very real issue.
