Legal Question in Real Estate Law in Florida

Condo Sale & Maintenance Fees

I purchased a condo last year. The seller agreed to pay my 1st year's condo fees. The title company sent a check to the property management company and stipulated that it was for ________(new owner's) condo fees for the next 12 months. When the management co. received the check they subtracted the previous owner's past due fees before crediting my account. At closing it was not disclosed to me (by the previous owner, the title company or the management company)that there were past due fees owed from the previous owner. The information was disclosed to me nine months later when I disputed my maintenance fee account balance. Am I responsible for the past due fees? Thank you for your help.

Re: Condo Sale & Maintenance Fees

No, but you will never get the Condo to give it back. Go after the prior owner and Title Co.
