Declaration of Condominium requires that...When Owner is in-residence, the ocupation may be up to 7 persons. What specifics are needed to show...Owner is in-residence ? For example, must Owner necessarily have to sleep overnight in the condo and counted as one of the occupants ? Must he always be present ? Etc.

This provision has been interpreted to mean that the owner is physically using the premises and is not otherwise residing somewhere else at the time of occupancy. For example, the owner is down from Ohio and is living for the next several weeks in the condo. If so, then 6 other individuals may join him for an overnight stay in the condo. This type of provision prevents an absentee owner from renting the premsies to large groups who cannot be held accountable by the condo association.
