Construction Lien
Hello, my wife and I recently purchased a house that was a foreclosure. The house was transferred between two holding companies before we purchased it. We bought the house with a clean title according to our title insurance. Recently we have had a maintenance/construction company contact us saying they are going to file a lien.
They are claiming debt unpaid for work that was performed on the house before we purchased it. The work was ordered by one of the companies before for clean-up and other miscellaneous tasks. They said they have tried to collect monies from them but have not gotten anything. The work was done about a year ago. The amount is about $4000.
Does this company have the right to file this lien; do they have a time limit? Can they foreclose on this house? Would it be best to get a lawyer involved?

You will probably have a claim against the title company who gave you a clean title for negligence or misrepresentation if they were aware of this or by due diligence could be aware of the lien.
Whether or not the construction company can place a lien on your property depends on whether or not you are in privity to such lien.
