Legal Question in Real Estate Law in Florida

Construction on Property

Is a landlord allowed to have contruction done to the house such as putting on a new roof of replacing the front steps while it is being leased, if the repairs are for aesthetic value rather then being to fix a leaky roof. Does this constitute unlivable conditions and therefore provide bias for legal action.

Re: Construction on Property

Yes, the landlord can take reasonable steps to improve the property, including installation of a new roof and front steps. It would be difficult to persuade a court of law, with a straight face, that such work for the benefit of the property, makes the premises uninhabitable --- unless the work is being conducted in such a manner as to actually make it impossible to occupy the premises. A new roof and new front steps should not take longer than a week or so. Relax. Good luck.
