coowner of house in florida

my husband and his sister co owner house in florida ( after dad's death in may 2008) they were quit claimed prior to his death. now my husband wants to sell and his sister who is living in the house does not. she wants to have a public auction in court but he wants to have a real estate agent sell it what can he do?

In an action in partition the court will order a sale.

He probably can't get what he wants. When co-owners disagree over whether to sell a house in Florida, one of them must file a partition. The result of a partition is that the judge orders an auction. When the partition is filed, though, maybe the sister will come to her senses and agree that it's best to settle the case by hiring a realtor so that more money can be made off the house.
